This database contains decisions on all public judicial disciplinary cases since the inception of the commission in 1960. Cases not involving public charges or public discipline remain confidential under the California Constitution and the commission’s rules.

Pursuant to amendments to the Constitution, which took effect in March 1995, the commission is authorized to impose all disciplinary sanctions, subject to discretionary review by the Supreme Court. Prior to that, the Supreme Court had the authority to censure or remove judges from office upon recommendation by the commission.

Summary Pursuant to a stipulation that included an agreement not to serve, the commission issued a public admonishment. The public admonishment related to Judge Tamietti’s misconduct in two criminal cases and also for discourteous comments he made in an email regarding the Nevada County District Attorney. The commission found that Judge Tamietti’s misconduct reflected a loss of the neutrality required of judges. Judge Tamietti’s misconduct included the appearance of bias against the local district attorney’s office; discourteous comments to and about the District Attorney; intrusion upon the charging authority of the district attorney’s office; ex parte communications that Judge Tamietti initiated; questioning of, and apparent retaliation against, a deputy district attorney for filing a peremptory challenge; and improperly choosing a successor judge after that peremptory challenge.
